Can a Credit Card Put a Lien on Your Home?

If you can’t make payments on your credit card can they put a lien on your house? ~Ketrina

ANSWER

Ketrina,

Unsecured cards are not attached to anything which means that there is no collateral that was agreed to be used for repayment of the debt. If you cannot make your payments, the creditor cannot just put a lien on your house.

The creditor, however, can take you to court and get a judgment, which is usually a fairly long process. Typically the time, court fees and expense for suing someone is not worth taking them to court. If the creditor does win a judgment against you, they will usually garnish your wages instead of putting a lien on your home, because with a lien they don’t get paid unless or until you sell your home.

Usually you can work something out with the creditor before they even go after a judgment just because a lot of credit card debt isn’t worth the expense of a lawsuit.

Hope this helps and good luck!
